         <description><![CDATA[<p>Thank you very much for this valuable information. <br />
I just have one question, should dream-act-eligible students file (with appropriate representation) for humanitarian parole and/or TPS in the good faith of this memos?</p>

<p>As a Dreamer and soon-to-be law student I am tempted to jump in to the conclusion that this policy change would benefit undocumented students even if they have not been apprehended and/or placed in deportation procedures. It seems reasonable that ICE would greatly benefit from having register as many dream-act stutudents as posssible.</p>

<p>Again, thank you for giving some light on this very intricate and obscured topics. </p>]]></description>

<p>Thank you for your comment. As I tried to suggest in my blog post, if ICE officials embrace Mr. Morton's prosecutorial discretion policies, then undocumented youth, as well as older foreign citizens who pose no threat to the United States, have reason to be hopeful that they may qualify for deferred action and employment authorization.</p>

<p>Regrettably, however, I cannot make any recommendation in an individual's case. Each person's situation is unique. Each person will have positive equities and perhaps some negative factors that should be evaluated by a competent immigration lawyer. Moreover, the attitude of local ICE officials toward Mr. Morton's instructions is critically important. A good immigration lawyer should be able to ascertain the local ICE office's inclinations on whether to embrace or oppose prosecutorial discretion. The American Immigration Lawyers Association has a lawyers referral service which undocumented youth may wish to consider as one source to find a qualified immigration lawyer.  www.aila.org.</p>

<p>By the way, deferred action and employment authorization are available even for those who may not qualify for humanitarian parole or TPS.</p>
